A new article has rised on the website of the EFF where Apple claims that iPhone jailbreaking is illegal (in the US). Apple’s iPhone, now the best-selling cellular phone in the U.S., has been designed with restrictions that prevent owners from running applications
obtained from sources other than Apple’s own iTunes App Store. “Jailbreaking” is the term used for removing these restrictions, thereby liberating your phone from Apple’s software “jail. Apple states that opening the iPhone to independently created applications will compromise safety, security, reliability, and swing the doors wide for those who want to run pirated software.

As part of the 2009 DMCA rulemaking, EFF has asked the Copyright Office to recognize an exemption to the DMCA to permit jailbreaking in order to allow iPhone owners to use their phones with applications that are not available from Apple’s store.(e.g., turn-by-turn directions, using the iPhone camera for video, laptop tethering).

in my opinion is that many people are trying to make awesome applications to improve performance in our daily life... apple's regulations that prevents certain applications to go to the itunes' app store they are just simple making a monopoly out of it...

and us as customers have the right to decide what ever we want to use our phones for... for that same reason we paid 200+ dollars for it... apple already have some money in their pockets... freaking greedy ppl

yea , they make a good point in that article.
its like buying a car.
they can void ur warranty if u say change the suspension but they can't stop you from actually changing it.
You own it!
Its yours to do what u like.

Otherwise Phones should be FREE and on Lease-

lol 1.6 million iphones are "illegal" jailbroken iPhones.
As often said, its the law that should be changed, not the people.

Apple never ceases to amaze me in how pathetic they are. They are so against anything that they didn't think of or don't want included in their products. I loved the iPhone when I first got it, but I didn't know what it truly was until I jailbroke mine. It's amazing how many restrictions they not only put on the iPhone itself, but also on the applications that are allowed to be in the appstore.

I never could understand why they didn't allow programs like SwirlyMMS, Video applications, alternatives to their crap SMS and Email, I mean why the heck do they allow people to type in landscape mode only in Safari, but not in Email and SMS, where 99.9% of the typing will be done?

The part that disgusts me most about Apple is how they don't listen to the consumer, they mostly only care about what they want to do and force it down on us like we should be grateful they exist and they allow us to own their product.

Its also illegal in some countries to lock phones so that they cannot be used on other networks, but Apple do it. selective laws from apple if you ask me.

Don`t forget Winterboard, that`s one of my reason for jailbreaking. Indeed I have to agree with Envision86 that iPhone can actually do more. I heard that bluetooth can actually work like other cellphones, but Apple restricts it, that`s just saddening :(

EFF are asking for jailbreaking to be added as not part of DMCA, apple just doesn't want it added to a law saying its legal. apple isn't getting a law passed saying its illegal.

Didnt I pay for the phone? Dont I have the right to smash it? Yes? Then I figure I also have the right to compromise my phone in any other way I wish. Sh*t, apple cant stop us. I have already exchanged a faulty "jailbroken" phone for a new one, as long as we restore, they dont know the difference, so where is the problem?
